Public Comment Period Deadline is November 7, 2025
In accordance with the RESTORE Act and its implementing regulations, the Alabama Department of Conservation and Natural Resources (ADCNR) is seeking public review and comment on Amendment 1 of the Alabama Multi-Year Implementation Plan (MIP). To review MIP Amendment 1, click here.
The Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies Act of 2012 (RESTORE Act) directs 80% of the civil penalties recovered as a result of the Deepwater Horizon oil spill to the Gulf Coast Restoration Trust Fund (Trust Fund) to be used by the five Gulf Coast states to restore and protect the environment and economy in the Gulf Coast region. Monies in the Trust Fund are distributed to five different components, one of which is the Direct Component, also referred to as Bucket 1. This component requires Alabama to prepare an MIP describing each activity, project or program for which Alabama seeks funding under Bucket 1.
In 2018, the U.S. Department of the Treasury (Treasury) approved Alabama’s initial MIP. The MIP contained 15 projects totaling approximately $192 Million, all of which addressed one or more eligible activities under the Direct Component Funding Opportunity administered by Treasury. The Alabama Gulf Coast Recovery Council (AGCRC) is now proposing to amend the MIP to reflect changes to the projects, budgets, and scopes of work.
On September 23, 2025, the AGCRC released a draft of Amendment 1 to Alabama’s MIP for a 45-day public comment period. The AGCRC will hold a virtual public meeting in November 2025 to vote on the amendment.
Public comment on the draft MIP Amendment 1 will be accepted until November 7, 2025. Comments can be submitted by email to agcrc@dcnr.alabama.gov or mailed to Alabama Gulf Coast Recovery Council, 31115 Five Rivers Blvd., Spanish Fort, AL 36527.
Comments received by the November 7, 2025 deadline will be reviewed and considered in preparing the final MIP Amendment 1 that will be submitted to Treasury.
The AGCRC was created with the passage of the RESTORE Act. The 10-member council consists of the Governor (chair); the Director of the Alabama State Port Authority (vice-chair); the Chairman of the Baldwin County Commission; the President of the Mobile County Commission; and the mayors of Bayou La Batre, Dauphin Island, Fairhope, Gulf Shores, Mobile and Orange Beach.
